Court of Appeals Denial of King County Motion to Stay May 10, 2022
On May 10, 2022 the Court denied King County’s motion to stay the GMHB decision that invalidated Adult Beverage Ordinance 19030 until the appeal is heard. A ‘stay’ is essentially a reversal of the opinion for a period of time. This request was made because while the County is out of compliance with GMA, state and federal loans and grants are at risk. Holding up loans and grants is the mechanism Washington State uses to require actual compliance with GMA by municipalities. In this case the County is saying $40m is at risk. The County could easily remedy their compliance issue by repealing 19030.
