King County Motion for Partial Summary Judgement

King County slid language into the 125+ page Ordinance stating that they may not start enforcing code for a minimum of 12 months after the effective date of the Ordinance. In other words, enforcement is at their discretion and on their timeline. Rather unbelievable given all their noise during this whole process about really enforcing code after the Ordinance passes. We have challenged that land use regulations cannot be compliant, as required, with the Growth Management Act if they are not enforced. The County asked the GMHB to throw this part of our challenge out in their Motion for Partial Summary Judgment. Our Response to the County’s motion will be submitted by the April 29 deadline.
