Motion to Stay GMHB Action Pending Appeal April 26, 2022
On April 26, 2022 King County requested that the Court of Appeals stay the GMHB decision from January 3, 2022 that invalidated Adult Beverage Ordinance 19030 until the appeal is heard. A ‘stay’ is essentially a reversal of the opinion for a period of time. This request was made because while the County is out of compliance with GMA, state and federal loans and grants are at risk. Holding up loans and grants is the mechanism Washington State uses to require actual compliance with GMA by municipalities. In this case the County is saying $40m is at risk.
